These Terms of Use (together with the documents referred to in them) govern your use of our platform and its related websites, services, applications, and tools. By using the services, you confirm that you accept these Terms of Use and also agree to abide by them.

Following terms and conditions which apply to any person registering as a Customer and using the Services of Carjoz

Registering on carjoz

Firstly, To benefit from all the features of the Services available, you will need to Sign-Up with us by filling out the Sign-Up form. Additionally, You have to provide certain information about yourself, including your name, contact details, and vehicle information. Clients must provide correct and complete information. They should also inform us promptly of any changes to the information that you have provided. You can update your details, so we can communicate with you effectively.

Services to Customers

We reserve the right to add, change or remove services from our platform. You can do it any time, and may make certain services chargeable at our discretion. You must only book a service if you have a genuine requirement for the work detailed to be performed. We are continually seeking to develop and improve the services we offer. Therefore, we reserve the right, at our absolute discretion, to make changes to any part of the Service without notice.

Payment

Some services made available for booking to you include the opportunity to make payments facilitated through our service. Currently we offer COD (Cash on Delivery) and for some services you may have to make some advance payment.

Online Payment

By making a payment through carjoz when online payment has opted, you undertake that the credit or debit card details or third party wallet login credentials you provide are for your credit or debit card or wallet account and that you have sufficient funds to make the payment for the services booked. In such cases, the price would be from a trusted third-party payment gateway.
We reserve the right to alter prices or services or cease to list services at any time without prior notice or warning.

Price for our Services

The total price shown for services is inclusive of the items described for that Service and may not include additional services found to be required at the time of availing your Service. In such a case, the service provider will discuss any change in scope with you. Moreover, Additional agreements or payments where required are made between you and the service provider.

d) Offer is applicable on services and labor charge.

Fuel Charges:

All fuel required for driving the vehicle from your home to service workshop(s) should be borne by the customer. If fuel is already available in the car executive will use that. In other cases, Carjoz will refuel the vehicle, and charges will be added to the service bill.

Involvement of Carjoz.

If you decide to cancel your appointment, you may do at any time. You can preferably use phone/Whatsapp, quoting your order number, or through the mail. If we accept your cancellation, no cancellation fee will be charged.

Our Responsibilities to you

We will provide Carjoz Services to you using reasonable skill and care and in accordance with these Terms of Use. However, if you use the carjoz Services as a customer you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers:
Although we have asked all users to use carjoz responsibly, we cannot guarantee the accuracy, integrity or quality of any information you view or receive of service workshops.

PLEASE NOTE: We carjoz will not under any circumstances have any responsibility to you or liability to you for the performance or quality of any work which you ask any service workshop to carry out.

Passwords and Security

If you register to use carjoz Services you will be given a username and password. You must keep your ID confidential and must not disclose it or share it with anyone. You are responsible for preventing unauthorised use of your ID.
If you believe there has been a breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms of Use, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issues has been resolved.

Acceptable Use Policy

The Services allow registered users to create, edit and submit material for inclusion on or transmission via Carjoz. We do not seek to monitor or control the submission of information; we reserve the right to delete, move and edit any Material submitted where (in our absolute discretion) we consider it prudent or necessary to do so.

Laws and Regulations

You agree to comply with all applicable laws and regulations when using Carjoz. Customers are solely responsible for all material they submit for inclusion on or transmission via Carjoz. Moreover, You must ensure that all material you transmit is lawful and honest.

You must not post or transmit any material that :

• is fraudulent, dishonest or misleading;
• is unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
• encourages conduct that constitutes a criminal offense. It also gives rise to civil liability, or otherwise breaches any applicable laws, regulations, or code of practice;
• infringes the copyright or other rights of any third party;
• is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).

By submitting material to us, you are also granting us a royalty-free, non-exclusive license to use, reproduce, modify, translate, available and distribute the material on or through Carjoz to operate services.

Disclaimer

 We endeavor to ensure that the information available on or through Carjoz is correct, up to date, and accurate. However, we do not warrant the accuracy and completeness of such material. In particular (but without limitation), Carjoz permits you to access and receive information supplied by third parties. The third parties submitting this information ensure that the material presented is accurate and complies with relevant laws and codes. Hence, We will not be responsible to you for the conduct of any such third party or for any error or inaccuracy in any material they supply. Although we aim to offer you the best service possible, we make no promise that the Services will meet your requirements. We cannot guarantee that Services will be fault-free or continuously available. 

Liability

To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings, or loss of data or for any indirect or consequential losses howsoever arising out of your use of Carjoz or any fault or problem relating to or any content received via Carjoz.
Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law. These terms and conditions will not affect your statutory rights as a consumer.

Liability on Carjoz Staff

You agree not to hold carjoz (or its stockholders, its affiliates, its licensors, partners, members, directors, managers, officers, employees, agents, successors, assigns, and content providers (collectively, “members”)) liable for any damages, expenses, losses, suits, claims, and controversies that have arisen or may arise, whether known or unknown, relating to your use of or inability to use the carjoz platform, including without limitation any liabilities arising in connection with the conduct, act or omission of any user or a third-party provider (including without limitation stalking, harassment, acts of physical violence, and loss or destruction of personal property), services, any dispute with any user or third-party provider, any instruction, advice, act, or Service provided by carjoz or members, and any destruction of your information.

Responsibility of Carjoz on damages 

Under no circumstances will carjoz or members be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising in connection with your use of or inability to use the carjoz platform or any services or merchandise, however, caused and on any theory of liability, whether in action for contract, strict liability, or tort (including negligence) or otherwise, including without limitation lost profits, lost earnings, lost data, personal injury, or property damage related to, whether or not carjoz has been advised of the possibility of such damages. Carjoz and members do not accept any liability with respect to the quality or fitness of any work performed in connection with the carjoz platform. Carjoz and members shall not be liable for any damages, liability, or losses arising out of:

(i) your use of or reliance on the services or your inability to access or use the services; or (ii) any transaction or relationship between you and any third-party provider, even if carjoz has been advised of the possibility of such damages. Carjoz shall not be liable for delay or failure in performance resulting from causes beyond carjoz’s reasonable control.

Carjoz and Users

You acknowledge that third-party providers providing car inspection, diagnosis, maintenance, repair, and towing services may not be professionally licensed or permitted. Clients may also use Carjoz’s services to request and schedule car inspection, diagnosis, maintenance, repair, and towing services with third-party providers. They agree that carjoz has no responsibility or liability to you relating to car inspection, diagnosis, maintenance, repair, and towing services provided to you by third-party providers other than as expressly outlined in these terms. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not apply to you. If, notwithstanding the preceding exclusions, it is determined that carjoz or members are liable for damages, in no event will the aggregate and total liability, whether arising in contract, tort, strict liability, or cause of action, exceed the amount invoiced for such job.

Carjoz as a venue for connecting

The carjoz platform is only a venue for connecting users. To the extent that the carjoz platform connects you to a third-party provider to provide services, carjoz will not be responsible for assessing any third-party providers’ suitability, legality, or ability. You expressly waive and release carjoz from any liability, claims, or damages arising from or in any way related to the third-party provider.

Limitations of Liability

Carjoz expressly disclaims any liability that may arise between you and a third-party provider in your use of carjoz platform. The third-party providers are responsible for the quality services scheduled or requested. You understand, therefore, that by using the carjoz platform, you may be exposed to services that are potentially dangerous, offensive, harmful, unsafe, or otherwise objectionable, and that you use the carjoz platform, and third party provider, at your own risk. Nothing in this agreement or the carjoz platform constitutes, or is meant to constitute advice of any kind. If you require advice about any legal, financial or medical matter you should consult an appropriate professional. Using the carjoz platform, you agree that the exclusions and limitations of liability set out in this agreement are reasonable. If you do not believe they are reasonable, you must not use the carjoz platform.

Termination of Services

We may suspend or cancel your registration and/ or terminate your access to Carjoz if you are in breach of these Terms of Use or have made improper use of The Services.
You may cancel your registration at any time by informing us in writing. If you do so you must stop using The Services.
The suspension, cancellation or termination of your registration and your right to use The Services shall not affect either party’s statutory right or liabilities.

General

All notices shall be given to us via email or by post using the contact details set out in the Contact Us section, or to you at either the email or postal address you provide during registration.
We may revise these Terms of Use at any time. You are expected to check these Terms of Use from time to time to take notice of any changes we make as they are legally binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our website.

Applicable Law

These Terms and Conditions will be subject to the laws of Hyderabad India and the courts shall have jurisdiction to resolve any disputes between us.
